For most projects the contractor is not selected at the outset of the project. Several contracting firms bid on the project and one is awarded a contract to construct the building. Many of the AIA owner-architect agreements require the Architect to assist the owner in the development and preparation of bidding documents. This can include determining the conditions of the Contract for Construction, the form of agreement between the owner and the contractor, and the conditions of the bid including bidding or proposal forms. Again, the owner may not have the sufficient expertise to perform these tasks on their own. The architect, acting as the owner’s representative, has the experience and expertise to assist in the preparation of the bid, but architects are not lawyers and are not required to prepare the legal documents associated with the bid and awarding of the bid. You may, however, be asked to assemble all of the necessary documents for the bidding process for the owner’s review. Sometimes the owner will prepare the documents for bidding on their own. If that is the case, it’s your responsibility to review those documents with your legal counsel with regards to the architect’s rights, duties, and responsibilities.
