NARRATOR V/O: Generally, you are not allowed to give gifts worth more than nominal value; however, there are some special circumstances where you may be allowed to give a gift worth more.
NARRATOR V/O: If you have a special circumstance, please declare it through the gift and entertainment reporting tool found on the right side of the PAL home page. The Legal and Compliance team then sends you a response.
NARRATOR V/O: You can provide business meals and entertainment as long as: the meal or entertainment is modest in scope and cost; the invitation is infrequent; the person hosting the meal attends; and the entertainment will not cause harm to PIMCO’s reputation.
SLIDE 15 – Gifts and Entertainment
NARRATOR V/O: In addition to these general standards, we also give special consideration when providing entertainment or giving a gift to a public entity, ERISA or a labor-union client.
NARRATOR V/O: These entities and the jurisdictions where they operate often impose additional restrictions on providing gifts and entertainment to public employees, officials, board members and others.
NARRATOR V/O: Because of this, you’re responsible for being aware of, and adhering to these special restrictions. If you are unsure of what restrictions apply, please consult with the compliance department.
NARRATOR V/O: Generally, you cannot give a gift to a government official.
NARRATOR V/O: If you violate one of these restrictions – which vary from place to place and plan to plan – PIMCO could incur a severe penalty, including disqualification from bidding on mandates, cancellation of existing mandates, and monetary fines.
NARRATOR V/O: If you have a question about giving gifts or hosting entertainment for a public entity, ERISA or labor-union client, please talk to someone from PIMCO Legal and Compliance.
SLIDE 16 – Gifts and Entertainment
NARRATOR V/O: Now let’s discuss policies that cover when you can receive a gift or entertainment.
NARRATOR V/O: Generally, you can’t accept gifts . . . although there are some exceptions. You can keep a nominal item, like a baseball hat. You can also keep an edible item, as long as you share it with your department. You can also keep a personal gift, like a book, as long as you get it approved by Legal and Compliance.
Before you keep anything else, please declare it and get compliance approval first.
NARRATOR V/O: Generally, you can accept a meal or entertainment if: the meal or entertainment is modest in scope and cost, and infrequent; the host attends; and the entertainment will not damage PIMCO’s reputation.
This includes: a modest business meal, an economic or strategy conference, or riding in a sedan with a vendor.
NARRATOR V/O: If you are a trade-floor employee, you also need to follow some special precautions: the meal or entertainment must be educational; it must be modest in scope and cost, and infrequent; the host providing the meal or entertainment must accompany you; your supervisor must pre-approve it; and you must report it to Compliance using the gift and entertainment reporting system.
